The Constitutional Court determined that in accordance with the powers that the Constitution gives  to the Nation and the territories, the decisions related to the exploration and exploitation of non-renewable natural resources of the subsoil, must be adopted in a concurrent and coordinated manner by the authorities of the Nation with the participation of the authorities of the territory through the mechanisms provided by law.

The Court decided that the "consulta popular" can not be used to prohibit extractive activities in a specific municipality or district.
