Protection of political speech

T-244/ 2018

Protection of political speech

In the political context, the rights to honor and good name are not unknown when expressing information and opinions on matters of public interest that have a vocation for truthfulness. The Court distinguished between the freedoms of expression of thought, opinion and information, especially when dealing with matters of public interest; therefore, concluded that the statements of a politician are protected by political discourse, understood as a dialectic that enjoys a special level of protection because of its importance for democracy, participation and pluralism.
