GENDER APPROACH IN LANGUAGE USED IN JUDICIAL DECISIONS IN CASE OF VICTIM OF SEXUAL VIOLENCE
The Court ordered the exclusion from the motivating part of the decision made by criminal judges, the vulgar and disqualifying phrases and expressions related to a victim of sexual violence. The Court recalled that in their judgments, judges must: (a) avoid value judgments that refer to the personality or physical aspect of the alleged victim of sexual violence, (b) quote in a literal way those relevant testimonies and their relevant sections that have a strict relationship to the criminal conduct being analyzed and (c) make the descriptions of the evidentiary assessment made in an objective tone and respectful of the statements of the alleged victim.
