Right to inclusive education of children in a disability situation

RIGHT TO INCLUSIVE EDUCATION OF CHILDREN IN A DISABILITY SITUATION-Obligation to guarantee access to education in regular study classrooms

In this case, the Court raiterates that the inclusive education is a commitment to recognize diversity and human dignity, through a model in which people with different abilities meet to access certain knowledge and enhance their abilities. It is based on the fact that all people must share the same spaces and can not be separated due to certain characteristics that have traditionally been classified as limitations to receive the same education. Inclusive education recognizes the differences among all people and highlights the equality that should prevail in society. It departs from the differentiation of normality and abnormality, which constituted a categorization to judge and isolate a group and restrict from the beginning of life, their rights.
