RIGHT OF TRANSGENDER PERSONS TO ACCESS HEALTH SERVICES

In this judgment, the Court defined the term transgender as a generic denomination with which those persons whose sexual and gender identity does not coincide with the one assigned to them at birth based on physical characteristics (biological sex) have been designated. The term is generic because it is used to describe plurality of manifestations, experiences and identities, and includes, among many others, transsexual, transgender, intergender, intersex, transvestite, drag queens, and drag kings. In this decision, the Court considered that the right to health and to the dignified life of a transgender person was violated and that the health service was not duly rendered. That is why he ordered the health company, with the help of an interdisciplinary group of doctors, to study the possibility of doing sex reassignment surgery.
