In this ruling, the Court protected the fundamental rights of two women to free movement, personal freedom and non-discrimination for their activity as sex workers. The Court also reaffirmed that prostitution is not a crime and that sexual services can not be equate to the sale of an object.

When granting a tutela action to two women who had been captured in an operation against sex workers in the center of Bogotá, the Constitutional Court gave a term of two months to the Alcalde Mayor to set up a work desk to analyze job opportunities of this population and that in a maximum term of one year implement a special program in this sense. Likewise, he ordered the Ombudsman's Office to provide training to the Metropolitan Police of Bogotá on the importance of the dignified treatment of sex workers and the prohibition of verbal and physical abuse.
