 DECISION T-634-13  PROTECTION OF SELF- IMAGE

 

In this case, the action for protection was filed by a woman against a massage company to claim the protection of her fundamental rights to personal and family privacy, good name, honor and human dignity, which she claimed have been violated by the defendant, when the company refused to remove from the social networking site Facebook and other media advertisements, several compromising photographs that, even though she had previously authorized their publication for advertising purposes, at present she considers that they affect the rights claimed. The Court considered that had violated the fundamental rights to self-image, honor, good name and privacy. Therefore it ordered the company to delete from FACEBOOK the images from the plaintiff, and to refrain in the future to disseminate them and publish by any means.
