 RIGHT TO FREEDOM OF LOCOMOTION OF PEOPLE IN DISABILITY SITUATION.

In two actions of protection filed independently, the petitioners argue that the respective Residential Complexes where they live,violate their fundamental rights, by refusing to build ramps that allow people with disabilities to access the apartments and common areas. The Court concludes that, by virtue of the principle of solidarity, a residential complex violates the fundamental rights to equality and the free movement of people in physical or motor disability who live in it, by refusing to remove the architectural barriers that confront them. they impede their free circulation, without propitiating serious spaces of agreement in which the material and legal possibility of adapting the infrastructure to make it accessible to all people is verified, or taking compensatory measures if necessary.
