The Court protects the right of consumers to know the health risks represented by the consumption of sugary drinks. The Constitutional Court ruled a tutela that wanted to protect the right of consumers to access a television notice about the effect of sugary drinks on health. The piece for television was censored by the Superintendence of Industry and Commerce in September 2016, when a tax on sugary drinks began to be debated in Congress.

The Court states that timely knowledge to this type of information "guarantees protection and prevention in health matters, by admitting the presumed or eventual risks linked to aspects of the development of these products" and also "enables the selection of a free way the food products that (consumers) want to consume, according to their own life orientation ".
